GENERAL TERMS AND CONDITIONS OF SALE
SECTION 1 – GENERAL PROVISIONS
Welcome to misteik. The terms "we," "us," and "our" refer to 3693 Company S.r.l., with registered office at Via Luigi Einaudi, 14 - 45100 Rovigo (RO), Italy, Tax Code and VAT No. 01668000290, Certified Email (PEC): 3693company@namirialpec.it, owner of misteik ("misteik").
These General Terms and Conditions of Sale (the "General Terms") apply to all sales contracts for the products available from time to time on the website https://misteik.com (the "Products"/"Product" and the "Website", respectively), concluded remotely between you and us through the Website (the "Contract").
You may purchase the Products only if you are at least 18 years old, act as a consumer, and make your purchases for purposes unrelated to any commercial, business, craft, or professional activity.
The language used for the conclusion of Contracts through this Website is Italian.
Before placing an order, you will be asked to accept these General Terms together with our Privacy Policy. We therefore invite you to read them carefully, save them, or print them for future reference.
As you will understand, failure to accept these General Terms makes it impossible to purchase Products from the Website.
misteik reserves the right to modify or update these General Terms at any time. In such case, an updated version will be published, indicating the "Last Updated" date at the top of the document. Your Contract will always be governed by the version of the General Terms in force at the time your order is submitted.
SECTION 2 – OUR PRODUCTS
misteik specializes in the sale of products from renowned Italian and international brands that feature minor imperfections but nevertheless retain their beauty, quality, and exclusivity.
For this reason, each Product available on the Website is a unique item.
Information regarding each Product, including the nature and location of any imperfections, together with the product code and price, is provided on the Website.
Although we cannot guarantee that the appearance of the Product will fully meet your expectations, we are committed to providing an accurate representation by including multiple photographs and detailed descriptions to help you make an informed purchase.
Please note, however, that the images displayed on the Website are for illustrative purposes only. Colours, fabrics, shades, textures, and finishes may differ from how they appear on your screen depending on your device and its display settings. We therefore recommend relying primarily on the Product description and specifications published on the Website.
SECTION 3 – PRICES
All Product prices displayed on the Website are expressed in Euro (€) and include all applicable taxes.
Shipping costs, where applicable, are charged separately and will be clearly indicated before you confirm your order.
misteik reserves the right to change Product prices at any time without prior notice. Any price changes will apply only to orders placed after the changes become effective.
SECTION 4 – ORDERS – CONCLUSION OF THE CONTRACT
When placing an order, you may be asked to create an account on the Website. This allows you to save your information and speed up future purchases.
Before submitting an order, we invite you to carefully read all information provided during the checkout process (including shipping costs, withdrawal conditions, and our Privacy Policy), as well as these General Terms, and to verify all information you have entered.
By submitting your order, you agree to pay the purchase price, and your purchase proposal will be governed by these General Terms.
To purchase Products, you must:
- add the desired Products to your Shopping Cart;
- complete the order with your personal details;
- select your preferred payment method;
- accept the General Terms and Privacy Policy;
- submit your order through the Website.
Before placing your order, you may modify the quantity of Products or remove Products from your Shopping Cart.
Please do not wait too long before completing your purchase, as Products placed in your cart are not reserved and may become unavailable.
Upon receipt of your order, misteik reserves the right to accept or reject it, for example in the event of:
- Product unavailability;
- irregular payment transactions;
- purchases made from outside Italy;
- previous breaches by the customer relating to earlier purchases.
In such cases, no payment will be charged.
The Contract is concluded when you receive our Order Confirmation email.
Acceptance (or rejection) of your order will be communicated to the email address you provided during checkout.
After receiving the Order Confirmation, Products may only be returned in accordance with Section 7 – Right of Withdrawal.
If one or more ordered Products are unavailable, you will be informed by email. In this case, the order will either be cancelled or fulfilled only for the available Products. Naturally, you will only be charged for the Products actually available.

SECTION 5 – PAYMENT
You may pay for Products and shipping costs (where applicable) using:
- Credit Card
- Cash on Delivery
- PayPal
- Klarna
We accept the following credit cards:
- Visa
- Mastercard
- Maestro
- American Express
No additional fees apply to any of the above payment methods.
Your credit card will only be charged after:
- your card details have been verified;
- authorization has been received from the card issuer;
- Product availability has been confirmed.
If payment cannot be successfully processed for any reason, the Contract will not be executed and the order will be automatically cancelled. You will be promptly informed.
An invoice will be issued for every order based on the information provided during checkout and will be sent to you by email in accordance with applicable law.
SECTION 6 – SHIPPING AND DELIVERY
Currently, Products can only be purchased within Italy, although we are working to extend our services to other European countries as soon as possible.
Products will be delivered to the shipping address specified during checkout.
Deliveries cannot be made to P.O. boxes, bars, tobacco shops, or unauthorized collection points.
Once your order has been shipped, misteik will send you a shipping confirmation email.
Upon delivery, we recommend that you:
- verify that the number of packages matches the delivery note;
- check that the packaging and seals are intact and show no signs of damage, moisture, or tampering;
- sign the delivery receipt (if required).
If you notice damage to the packaging or Products, or discrepancies in the number of packages, please report this immediately in writing on the courier's delivery receipt. Otherwise, we may be unable to assist you.
The risk of loss, damage, or destruction of the Products passes to you once the Products have been delivered to the address you specified and received by you or by a person acting on your behalf.
SECTION 7 – RIGHT OF WITHDRAWAL – RETURNS
As required by law, you have the right to withdraw from the Contract within 14 (fourteen) days from the date on which the Products were delivered, or, in the case of multiple deliveries relating to the same order, from the date of the last delivery.
The right of withdrawal does not apply to:
- customized products;
- sealed goods that have been opened after delivery and are unsuitable for return for health or hygiene reasons (such as opened cosmetic products).
Within the withdrawal period, you may:
- select "Return Item" from your misteik account;
or
- notify us by any other means, optionally using the withdrawal form available on our Website, providing your full name, email address, order number, Product description, and date of receipt.
The withdrawal period is deemed respected if your communication is sent before it expires.
Within 14 days after notifying us of your withdrawal, you must return the Products to:

using the return procedure that we will communicate to you.
Return shipping costs are borne by the customer.
Returned Products must be complete, unused, undamaged (except for defects already disclosed by misteik before purchase), including accessories, original packaging, attached tags, and accompanying documentation.
After inspection, misteik will process your refund.
We reserve the right to assess any reduction in the Product's value caused by handling beyond what is necessary to determine its nature, characteristics, and functioning (for example, wearing garments for an evening event or a photo shoot, or removing tags).
Refunds will be issued using the same payment method used for the original transaction unless you request that the amount be credited to your misteik account for future purchases.
SECTION 8 – WARRANTY FOR DEFECTS
Because our Products are intentionally sold with minor imperfections that are clearly disclosed on the Website, no warranty is provided for defects that were already described before the order was placed.
We also do not cover alterations, modifications, or damage caused by the customer after delivery.
Subject to the above, misteik recognizes the Legal Guarantee of Conformity provided under the Italian Consumer Code.

Since every Product is unique and manufactured by third parties, replacement or repair may not always be possible. Where the legal warranty applies, all other remedies provided by consumer protection law remain available.
Upon receiving the returned Product, we reserve the right to verify the existence of the reported defect and whether it is covered by the legal warranty.
If the claim is accepted, we will refund the amount paid using the original payment method unless you request store credit for future purchases.
SECTION 9 – AUTHENTICITY GUARANTEE AND INTELLECTUAL PROPERTY RIGHTS
misteik guarantees that all Products sold on the Website are authentic products from the brands indicated.
Please note that misteik is not the owner of the trademarks displayed in the Product descriptions. All trademarks remain the intellectual property of their respective owners.
SECTION 10 – APPLICABLE LAW, JURISDICTION, AND ODR
These General Terms, and all Contracts concluded under them, are governed by Italian law and shall be interpreted accordingly.
Should any dispute arise, we kindly invite you to contact us first using the contact details provided in Section 11 so that we may attempt to resolve the matter amicably.
If no amicable solution can be reached, disputes arising from the interpretation, validity, or performance of these General Terms shall fall within the jurisdiction of the court of your place of residence or domicile.
